        AN ACT to amend the environmental conservation law, in relation to regu-
          lation of liquid, food and beverage containers containing bisphenol A
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The environmental conservation law is amended by adding a
     2  new section 37-0506 to read as follows:
     3  § 37-0506. Food and beverage containers.
     4    1. Beginning December first, two thousand eighteen,  no  person  shall
     5  sell  or  offer  for  sale any liquid, food or beverage in a can, jar or
     6  other container containing bisphenol A.
     7    2. A manufacturer of a liquid, food or beverage product as  identified
     8  in  subdivision  one  of  this section may apply to the department for a
     9  waiver of the requirements of subdivision one  of  this  section  for  a
    10  period  of one year, upon proof that there are no available alternatives
    11  to bisphenol A in the manufacture of such can, jar  or  other  container
    12  that  is  subject  to the provisions of subdivision one of this section.
    13  After the granting of such a waiver to a manufacturer, it may thereafter
    14  apply for one additional one year waiver.
    15    § 2. This act shall take effect immediately.
