        Introduced by M. of A. CASTRO -- read once and referred to the Committee
          on Health
 
        AN  ACT to amend the public health law, in relation to prohibiting smok-
          ing in indoor common areas of multiple dwelling properties
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 

     1    Section  1.  Paragraphs  q and r of subdivision 1 of section 1399-o of
     2  the public health law, as amended by chapter 389 of the  laws  of  2011,
     3  are amended and a new paragraph s is added to read as follows:
     4    q. zoos; [and]
     5    r. bingo facilities[.]; and
     6    s.  common areas of multiple dwellings, including elevators, hallways,
     7  entrances, and exits. For the purposes of this paragraph:
     8    (1) "multiple dwelling" shall mean a dwelling  that  is  occupied  for
     9  permanent  residence purposes of three or more families living independ-
    10  ently of each other.
    11    (2) "permanent residence purposes" shall consist  of  occupancy  of  a
    12  dwelling  unit  by  the same natural person or family for thirty consec-
    13  utive days or more.

    14    (3) "dwelling unit" shall mean any room  or  group  of  rooms  located
    15  within  a  dwelling  and forming a single habitable unit with facilities
    16  which are used or intended to be used for living or  sleeping  by  human
    17  occupants.
    18    §  2. This act shall take effect one year after it shall have become a
    19  law.
