        AN  ACT  to  amend  the  penal  law,  in  relation to licenses to carry,
          possess, repair and dispose of firearms issued to military veterans
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Paragraph  (l)  of subdivision 1 of section 400.00 of the
     2  penal law, as amended by chapter 1 of the laws of 2013,  is  amended  to
     3  read as follows:
     4    (l)  in  [the]  any  county  [of  Westchester,  who  has  successfully
     5  completed] which requires successful completion  of  a  firearms  safety
     6  course  and  test  as evidenced by a certificate of completion issued in
     7  [his or her] the applicant's name and endorsed and  affirmed  under  the
     8  penalties of perjury by a duly authorized instructor, [except that: (i)]
     9  persons  who are honorably discharged from the United States army, navy,

    10  marine corps or coast guard, or [of] from  the  national  guard  of  the
    11  state  of  New  York, within eight years prior to applying for a license
    12  and produce evidence of official qualification in  firearms  during  the
    13  term  of  service  are  not  required to have completed those hours of a
    14  firearms safety course pertaining to the safe use, carrying, possession,
    15  maintenance and storage of a firearm[;]  and  [(ii)]  persons  who  were
    16  licensed  to possess a pistol or revolver prior to the effective date of
    17  this paragraph are not required to  have  completed  a  firearms  safety
    18  course and test;
    19    §  2.  Subdivision 4-b of section 400.00 of the penal law, as added by
    20  chapter 446 of the laws of 1997, is amended to read as follows:
    21    4-b. Westchester county firearms safety  course  certificate.  In  the

    22  county of Westchester, at the time of application, the licensing officer
    23  to  which  the  license  application is made shall provide a copy of the
    24  safety course booklet to each license applicant. Before such license  is

     1  issued, such licensing officer shall require that the applicant submit a
     2  certificate  of  successful  completion  of a firearms safety course and
     3  test issued in his or her name  and  endorsed  and  affirmed  under  the
     4  penalties  of  perjury by a duly authorized instructor unless the appli-

     5  cant has been honorably discharged from the United  States  army,  navy,
     6  marine  corps or coast guard, or from the national guard of the state of
     7  New York, within eight years prior to applying for  a  license  and  can
     8  produce  evidence  of official qualification in firearms during the term
     9  of service.
    10    § 3. This act shall take effect immediately; provided that section one
    11  of this act shall take effect on the same date and in the same manner as
    12  section 48 of chapter 1 of the laws of 2013, takes effect.
