        AN  ACT  to  amend  the  insurance  law  and the social services law, in
          relation to requiring health insurance policies to fully cover  multi-
          marker  testing  related to ovarian cancer to patients which have been
          diagnosed with an ovarian adnexal mass

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subsection  (i)  of  section 3216 of the insurance law is
     2  amended by adding a new paragraph 11-c to read as follows:
     3    (11-c) (A) Every policy that provides coverage for hospital,  surgical
     4  or  medical  care  shall  offer  full  coverage for multi-marker testing
     5  related to ovarian cancer to patients which have been diagnosed with  an
     6  ovarian adnexal mass.
     7    (B)  Such  additional  coverage shall not be subject to annual deduct-
     8  ibles and coinsurance but shall be borne solely by the insurer.
     9    § 2. Subsection (l) of section 3221 of the insurance law is amended by
    10  adding a new paragraph 11-c to read as follows:
    11    (11-c) (A) Every insurer delivering a group or blanket policy or issu-
    12  ing a group or blanket policy for delivery in this state  that  provides
    13  coverage  for hospital, surgical or medical care shall offer full cover-
    14  age for multi-marker testing related to ovarian cancer to patients which
    15  have been diagnosed with an ovarian adnexal mass.
    16    (B) Such additional coverage shall not be subject  to  annual  deduct-
    17  ibles and coinsurance but shall be borne solely by the insurer.
    18    §  3.  Section  4303  of  the insurance law is amended by adding a new
    19  subsection (p-1) to read as follows:
    20    (p-1) (1) A medical expense indemnity corporation, a hospital  service
    21  corporation  or  a health service corporation that provides coverage for
    22  hospital, surgical or medical care shall offer full coverage for  multi-

     1  marker  testing  related  to  ovarian cancer to patients which have been
     2  diagnosed with an ovarian adnexal mass.
     3    (2)  Such  additional  coverage shall not be subject to annual deduct-
     4  ibles and coinsurance but shall be borne solely by the insurer.
     5    § 4. Subdivision 2 of section 365-a of  the  social  services  law  is
     6  amended by adding a new paragraph (kk) to read as follows:
     7    (kk)  multi-marker testing related to ovarian cancer to patients which
     8  have been diagnosed with an ovarian adnexal mass.
     9    § 5. This act shall take effect on the first of January next  succeed-
    10  ing  the  date  on  which  it shall have become a law and shall apply to
    11  policies issued, reissued, renewed, modified or amended on or after such
    12  date.
