  TITLE OF BILL: An act in relation to authorizing the state cemetery board to accept from the town of Clarkstown an application for funding from the state cemetery vandalism restoration, monument repair or removal and adminis- tration fund for three abandoned cemeteries   PURPOSE OR GENERAL IDEA OF BILL: To allow the Town of Clarkstown to apply for funding established pursu- ant to section 97-r of the state finance law for maintenance of the three enumerated cemeteries   SUMMARY OF SPECIFIC PROVISIONS: Section 1 of this bill states, notwithstanding any provision of law, rule or regulation to the contrary, the state cemetery board is hereby authorized to accept from the town of Clarkstown, Rockland county, an application for funding from the state cemetery vandalism restoration, monument repair or removal and administration fund established pursuant to section 97-r of . the state finance law for the maintenance of the following abandoned cemeteries: the Nyack Rural Cemetery and the Mount Moor Cemetery, both located in West Nyack, and the Nanuet Cemetery, located in Nanuet. Section 2 of the bill states that this act shall take effect immediate- ly.   JUSTIFICATION: This bill seeks to allow the Town of Clarkstown to access funding avail- able, under section 97-r of the state finance law, for the maintenance of three abandoned cemeteries within.its municipality.   PRIOR LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately

          Committee on Corporations, Authorities and Commissions
 
        AN ACT in relation to authorizing the state  cemetery  board  to  accept
          from  the town of Clarkstown an application for funding from the state
          cemetery vandalism restoration, monument repair or removal and  admin-
          istration fund for three abandoned cemeteries
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Notwithstanding any provision of law, rule or regulation to
     2  the contrary, the state cemetery board is hereby  authorized  to  accept
     3  from the town of Clarkstown, Rockland county, an application for funding
     4  from  the  state  cemetery  vandalism  restoration,  monument  repair or
     5  removal and administration fund established pursuant to section 97-r  of
     6  the  state  finance  law  for the maintenance of the following abandoned
     7  cemeteries:  the Nyack Rural Cemetery and the Mount Moor Cemetery,  both
     8  located in West Nyack, and the Nanuet Cemetery, located in Nanuet.
     9    If  satisfied  that the town of Clarkstown would otherwise be entitled
    10  to such funding if such town had filed applications for the  funding  by
    11  the  appropriate  dates,  the state cemetery board may make available to
    12  the town appropriate amounts for the  repair  and  maintenance  of  such
    13  abandoned cemeteries pursuant to article 15 of the not-for-profit corpo-
    14  ration law.
    15    § 2. This act shall take effect immediately.
