AN ACT to amend the general business law, in relation to selling and
manufacturing of fur-bearing articles of clothing
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general business law is amended by adding a new section
2 399-aaa to read as follows:
3 § 399-aaa. Selling and manufacturing of fur-bearing articles of cloth-
4 ing. 1. For the purposes of this section the following terms shall have
5 the following meanings:
6 (a) "faux fur" shall mean artificially manufactured fur which is made
7 to resemble real fur but which is not derived from animals.
8 (b) "real fur" shall mean animal skin or part thereof with hair,
9 fleece, or fur fibers attached thereto, either in its raw or processed
10 state.
11 2. It shall be unlawful for any person, firm, partnership or corpo-
12 ration to knowingly import for profit, sell at retail, offer for sale at
13 retail, or manufacture articles of clothing which include, or have
14 attached in any quantity and of any value, fur that is not labeled as
15 being "faux fur" or "real fur", or is incorrectly labeled.
16 3. Labeling of articles of clothing pursuant to this section may be
17 accomplished by adding "faux fur" or "real fur" to the permanent tag
18 attached to the clothing, to the temporary tag used by the merchant to
19 identify the merchandise, or by affixing, in a conspicuous place, a
20 sticker stating "faux fur" or "real fur" to the article of clothing
21 itself.
22 Articles of clothing containing or having attached any quantity or
23 value of "real fur" shall have certain disclosures on the label required

1 in this section so as not to be considered misbranded under 15 U.S.C.
2 69b.
3 4. A violation of this section shall be punishable by a fine of not
4 more than five hundred dollars for the first violation and not more than
5 one thousand dollars for each subsequent violation.
6 § 2. This act shall take effect on the ninetieth day after it shall
7 have become a law.
