        AN ACT to amend the alcoholic beverage control law, in  relation  to  an
          exemption  for  certain property from the prohibition of alcohol sales
          within a certain distance from a church
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subdivision  7  of  section  64 of the alcoholic beverage
     2  control law is amended by adding a  new  paragraph  (e-16)  to  read  as
     3  follows:
     4    (e-16)  Notwithstanding the provisions of paragraph (a) of this subdi-
     5  vision, the  authority  may  issue  a  retail  license  for  on-premises
     6  consumption  for  a  premises  which shall be located within two hundred
     7  feet of a building occupied as a church, synagogue  or  other  place  of
     8  worship,  provided  such  premises constitute a premises for the sale of
     9  food or beverages at retail for  consumption  on  the  premises  located
    10  wholly  within  the  boundaries  of  the county of Saratoga, bounded and
    11  described as follows:
    12    All that certain tract, piece or parcel of land,  situate,  lying  and
    13  being  in  the city of Saratoga Springs, county of Saratoga and state of
    14  New York, bounded and described as follows:
    15    Commencing at a point in the northerly line of Washington Street where
    16  the division line between the land hereby described and the land now  or
    17  late  of  Peter  V.  Wiggins meets the said northerly line of Washington
    18  Street and running thence westerly along  the  said  northerly  line  of
    19  Washington  Street one hundred ten (110') feet more or less to the divi-
    20  sion line between the land hereby described and the land now or late  of
    21  Edward  R.  Stevens thence northerly along the easterly line of the said
    22  now or late of Edward R. Stevens one hundred seventy-one  feet  and  six
    23  inches  more or less to the line of the land of the United States Hotel,
    24  thence easterly along the line of  land  of  the  United  States  Hotel,
    25  thence  easterly  along  the line of the United States Hotel one hundred
    26  twelve feet more or less and thence southerly along the westerly line of
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1  said land of late Peter V. Wiggins two hundred feet more or less to  the
     2  northerly line of Washington Street at the place of beginning.
     3    Being  the  same  premises described in an exclusive easement from the
     4  Universal Baptist Church of  Saratoga  Springs,  New  York  to  Saratoga
     5  Springs Universal Preservation Hall, dated January 26, 2004 and recorded
     6  in  the Saratoga County Clerk's Office on February 25, 2004 in Book 1674
     7  of Deeds at Page 268.
     8    § 2. This act shall take effect immediately.
