        Introduced  by M. of A. BENDETT -- read once and referred to the Commit-
          tee on Corporations, Authorities and Commissions
 
        AN ACT to amend the public service law, in relation to making all  costs
          and  expenses  of  the department of public service and public service
          commission subject to appropriation by the legislature; and to  repeal
          certain  provisions  of  section  18-a  of  the public service law, in
          relation thereto
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The  section heading and subdivision 1 of section 18-a of
     2  the public service law, as amended by section 2 of part NN of chapter 59
     3  of the laws of 2009, are amended to read as follows:
     4    Costs and expenses of the commission and department [and  the  assess-
     5  ment  of  such  costs  and  expenses.  1]. All costs and expenses of the
     6  department and commission shall be paid pursuant to appropriation by the
     7  legislature on the certification of the chairman of the  department  and
     8  upon the audit and warrant of the comptroller. [The state treasury shall
     9  be  reimbursed  therefore by payments to be made thereto from all moneys
    10  collected pursuant to this chapter. The total of such costs and expenses
    11  shall be borne by  the  public  utility  companies  (including  for  the
    12  purposes  of  this  section  municipalities other than municipalities as
    13  defined in section eighty-nine-l of this chapter), corporations (includ-
    14  ing the power authority of the state of New York), and  persons  subject
    15  to the commission's regulation, to be assessed in the manner provided in
    16  subdivisions two, three and four of this section and section two hundred
    17  seventeen of this chapter.]
    18    §  2. Subdivisions 1-a, 2, 3, 4, 4-a, 4-b and 5 of section 18-a of the
    19  public service law are REPEALED.
    20    § 3. This act shall take effect January 1, 2025.
