        Introduced  by  Sen.  MAYER  -- read twice and ordered printed, and when

        AN ACT to amend the vehicle and traffic law, in relation to the residen-
          tial parking system in the town of Harrison
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Legislative findings and intent. The legislature finds that
     2  a lack of parking for residents of certain areas of the town of Harrison
     3  has resulted in traffic hazards, congestion and air and noise pollution.
     4  In addition, such lack of parking poses a hazard to residents and  other
     5  pedestrians in such area.
     6    The  legislature  further finds that a residential parking system will
     7  reduce such hazards and will reduce pollution levels as well. The legis-
     8  lature, therefore, hereby declares the necessity of this act to  author-
     9  ize  the  town  of  Harrison  to  adopt  a residential parking system in
    10  accordance with the provisions of this act.
    11    § 2. Subdivision 2 of section 1662-c of the vehicle and  traffic  law,
    12  as  added  by  chapter  265  of  the laws of 1998, is amended to read as
    13  follows:
    14    2. Such residential parking system may only be established [within]:
    15    (a) Within the area of the town of Harrison  [which  shall  mean  that
    16  area] generally bounded by the following:
    17    [All  of  that  area] beginning at the intersection of Harrison Avenue
    18  and Broadway; running north on  Harrison  Avenue  to  Davenport  Street;
    19  thence  running east on Davenport Street to Oakland Avenue; then running
    20  north along Oakland Avenue to the intersection  of  Macy  Road;  running
    21  thence  north  on  Macy  Road to the intersection of Macy Road and South
    22  Road and Sunnyside Avenue; running thence west along Sunnyside Avenue to

     1  Sunnyside Place; thence north to Emerson  Place;  thence  along  Emerson

    13  Pearl  Avenue;  thence running south on Pearl Avenue to Harrison Street;
    14  thence running west on Harrison Street to Willow Street; thence  running
    15  south on Willow Street to Elmwood Avenue; thence running east on Elmwood
    16  Avenue  to Underhill Avenue; thence running south on Underhill Avenue to
    17  Locust Avenue; thence running east  on  Locust  Avenue  to  Main  Place;
    18  thence  running  north  on Main Place to Parkview Avenue; thence running
    19  west on Parkview Avenue to White Plains Avenue; thence running north  on
    20  White  Plains  Avenue to High Street; thence running east on High Street

    39    (ii) Dey Street from Ann Street to the dead end;
    40    (iii) Edward Street from Pearl Avenue to the dead end;
    41    (iv)  Main Street from Underhill Avenue to the border with the city of
    42  White Plains;
    43    (v) Underhill Place from Underhill Avenue to the dead end;
    44    (vi) Park Place from Underhill Avenue to the dead end;
    45    (vii) Locust Avenue from Main Place to the dead end;
    46    (viii) Parkview Avenue from Main Place to the dead end;
    47    (ix) High Street from Kingston Avenue to the dead end;
    48    (x) Spring Lake Drive from High Street to the dead end;
    49    (xi) Clark Place from White Plains Avenue to the dead end;
    50    (xii) Taylor Avenue from White Plains Avenue to the dead end;
    51    (xiii) Harrison Street from Woodside Avenue to Sherman Avenue;
    52    (xiv) Madison Street from Woodside Avenue to Sherman Avenue;
    53    (xv) Sherman Avenue from Madison Street to the dead end;
    54    (xvi) Livingston Street from Woodside Avenue to the dead end;
    55    (xvii) Woodside Avenue from Jefferson Street to the dead end;
    56    (xviii) Park Avenue from Washington Street to the dead end;

     1    (xix) Washington Street running east from Park Avenue to the dead end;
     2    (xx) Lakeview Avenue from Washington Street to the dead end;
     3    (xxi)  Washington Street running west from Lakeview Avenue to the dead
     4  end;
     5    (xxii) Gainsborg Avenue from Washington Street to the dead end; and
     6    (xxiii) Lincoln Avenue from Washington Street to the dead end.
     7    For the purposes of this subdivision, permit  parking  may  be  imple-
     8  mented  on both sides of any street whose center line is herein utilized
     9  as a boundary description.   Provided,  however,  that  except  for  the
    10  reference  to  state highways solely for the purposes of delineating the
    11  boundaries of the area described in this subdivision, the provisions  of
    12  this  section  shall  not  apply  to any state highway maintained by the
    13  state.
    14    § 3. Paragraph (d) of subdivision 4 of section 1662-c of  the  vehicle
    15  and traffic law, as added by chapter 265 of the laws of 1998, is amended
    16  to read as follows:
    17    (d)  make  not less than [twenty] fifteen percent of all spaces within
    18  the permit area available to nonresidents and shall provide  short  term
    19  parking of not less than ninety minutes in duration in such area; and
    20    § 4. This act shall take effect immediately.
