Enacts the "NY plastic free act"; prohibits the sale or distribution of single-use plastic products in the state; defines terms; provides exceptions for persons with medical conditions and single-use plastic bags for garbage collection.

AN ACT to amend the environmental conservation law, in relation to
enacting the "NY plastic free act"
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Short title. This act shall be known and may be cited as
2 the "NY plastic free act".
3 § 2. Article 27 of the environmental conservation law is amended by
4 adding a new title 34 to read as follows:

6 NY PLASTIC FREE ACT
7 Section 27-3401. Definition.
8 27-3403. Single-use plastic products prohibited.
9 § 27-3401. Definition.
10 For the purposes of this title, "single-use plastic products" shall
11 include:
12 1. plastic bags;
13 2. cling film plastic food packaging;
14 3. non-recyclable plastic bottles;
15 4. plastic straws;
16 5. plastic plates, non-reusable plastic containers, plastic cups,
17 plastic lids, and plastic stirrers;
18 6. plastic cutlery;
19 7. plastic rings used in packaging;
20 8. styrofoam plates, styrofoam take-away containers and styrofoam
21 trays; and
22 9. any other single-use plastic products determined to be included by
23 the department.
24 § 27-3403. Single-use plastic products prohibited.

1 1. No person, firm, partnership, association, limited liability compa-
2 ny or corporation shall sell or offer for sale or provide to any person
3 in the state any single-use plastic products.
4 2. This section shall not apply to:
5 (a) the purchase of plastic straws for a person requiring such straws
6 due to a medical condition;
7 (b) the purchase of single-use plastic bags for garbage collection;
8 and
9 (c) single-use plastic medical equipment.
10 § 3. This act shall take effect on the sixtieth day after it shall
11 have become a law.
