  TITLE OF BILL: An act to amend the insurance law, in relation to anti-arson applications   PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to amend paragraph 2 of subsection (g) of section 3403 of the insurance law to only apply to cities with a popu- lation of one million or more persons according to the nineteen hundred seventy census.   SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends paragraph 2 of subsection (g) of section 3403 of the insurance law to restrict its automatic application to cities with over four hundred thousand person populations. Section 2 sets an immediate effective date.   JUSTIFICATION: When New York first enacted this law, arson for profit reached a signif- icant point due in large part to specific economic circumstances. Those circumstances are no longer present and the methods of investigating arson no longer make it necessary to continue this act. Further, this bill singles out Buffalo as the only upstate city to which it automat- ically applies. This causes time and effort to be wasted when attempting to secure insurance in Buffalo. This legislative change would stop this unfair treatment of Buffalo.   PRIOR LEGISLATIVE HISTORY: This is a new bill.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend the insurance law, in relation  to  anti-arson  applica-
          tions
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph 2 of subsection (g) of section 3403 of the insur-
     2  ance law is amended to read as follows:
     3    (2) The provisions of this section shall only apply to cities  with  a
     4  population  [over  four hundred thousand] of one million or more persons
     5  according to the nineteen hundred seventy census, except that  within  a
     6  reasonable  time  after receiving a petition by the governing board of a
     7  local municipal corporation as those terms are defined in article one of
     8  the general municipal law, the superintendent shall mandate the  use  of
     9  the  anti-arson  application  within  specific designations contained in
    10  such petition.
    11    § 2. This act shall take effect immediately.
