MEMORANDUM IN SUPPORT OF LEGISLATION

  TITLE OF BILL: An act to amend the general construction law, in relation to designating September 11 as a public holiday known as the State Day of Remembrance and Recognition   PURPOSE: This bill designates September 11 as a public holiday known as the State Day of Remembrance and Recognition.   SUMMARY OF PROVISIONS: Section 1 of this legislation amends section 24 of the general construction law, as amended by chapter 347 of the laws of 1984. Section 2 enacts this bill immediately.   JUSTIFICATION: On September 11, 2001, our state and our nation witnessed a tremendous tragedy. In the wake of the attacks on the World Trade Center, over 6,000 New Yorkers lost their lives, including over 400 New York City police officers, firefighters, EMT's, and other rescue personnel. The impact on the city and its people can not be understated. As a people, we come together to mourn the passing of family, friends, and loved ones, but as a nation we unite in our strength and in our perseverance. Although we will never forget the events of that fateful Tuesday, this bill calls for a special day to take time out of our daily routines to pause and to reflect on those workers and rescue personnel that died. Just as Veterans Day brings us together to recall those who bravely defended our country and our freedoms, so to should we gather to recog- nize the courage of those members of the NYPD, FDNY, the EMT's, and all other rescue personnel who threw themselves into harm's way in the hopes of saving lives. In the future, New Yorkers will set September 11th aside to give recognition to our emergency service personnel who contin- ue to serve as a beacon of hope to the rest of the world, New York City was built upon the backs of people from all over the world and it will be from their tireless efforts that this city will be forged anew.   LEGISLATIVE HISTORY: New bill.   FISCAL IMPLICATIONS: None.   EFFECTIVE DATE: This act shall take effect immediately.

        AN ACT to amend the general construction law, in relation to designating
          September 11 as a public holiday known as the State Day of Remembrance
          and Recognition
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section 24 of the general construction law, as amended by
     2  chapter 347 of the laws of 1984, is amended to read as follows:
     3    § 24. Public holidays; half-holidays. The term public holiday includes
     4  the following days in each year:  the first day of January, known as New
     5  Year's day; the third Monday of January,  known  as  Dr.  Martin  Luther
     6  King, Jr. day; the twelfth day of February, known as Lincoln's birthday;
     7  the  third  Monday in February, known as Washington's birthday; the last
     8  Monday in May, known as Memorial day; the second Sunday in  June,  known
     9  as  Flag  day;  the  fourth  day of July, known as Independence day; the
    10  first Monday in September, known as  Labor  day;  the  eleventh  day  of

    11  September,  known  as  the State Day of Remembrance and Recognition; the
    12  second Monday in October, known as Columbus day;  the  eleventh  day  of
    13  November, known as Veterans' day; the fourth Thursday in November, known
    14  as  Thanksgiving  day;  and  the  twenty-fifth day of December, known as
    15  Christmas day, and if any of such days except Flag day  is  Sunday,  the
    16  next  day  thereafter; each general election day, and each day appointed
    17  by the president of the United States or by the governor of  this  state
    18  as  a  day of general thanksgiving, general fasting and prayer, or other
    19  general religious observances. The term half-holiday includes the period
    20  from noon to midnight of each Saturday which is not a public holiday.
    21    § 2. This act shall take effect immediately.
