        AN ACT to amend the Nassau County Civil Divisions Act,  in  relation  to
          the Volunteer and Exempt Firemen's Benevolent Association of Westbury
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Sections 625.1, 625.4 and 625.5 of the Nassau County  Civil
     2  Divisions  Act,  as added by chapter 64 of the laws of 1940, are amended
     3  to read as follows:
     4    § 625.1. Purposes. The purposes  of  such  corporation  shall  be  the
     5  relief,  aid and assistance of the members of such corporation and their
     6  immediate families, who are injured, disabled or indigent, to maintain a
     7  suitable headquarters for such members of such corporation,  to  provide
     8  for  the health and safety of the volunteer members of a corporation, to
     9  enhance the morale of  the  volunteer  members  of  the  corporation  by
    10  providing  social  and recreational activities for the volunteer members
    11  of a corporation, and the promotion of the welfare of the volunteer fire
    12  service in the territory protected by the Westbury fire department.
    13    § 625.4. Control and disposal of funds and property. The  control  and
    14  disposal  of  the  funds,  property  and estate of such corporation, the
    15  exercise of its powers and the management of its affairs shall be vested
    16  in a board of trustees, which shall consist of [five] eleven members  of
    17  such  corporation,  to wit: the president, the first vice president, the
    18  second vice president, the secretary, the financial secretary, the trea-
    19  surer and five other members having the title of trustee. [The  officers
    20  of  such  corporation  shall  be in such number and designated and shall
    21  have and exercise such powers and duties  as  may  be  provided  by  the
    22  by-laws.] The trustees and officers shall be elected at the annual meet-

     1  ing  of  such  corporation  in the manner prescribed by its by-laws. The
     2  funds of such corporation, by unanimous vote of the board  of  trustees,
     3  may  be used [for the relief, aid and assistance of disabled or indigent
     4  active  or  exempt volunteer firemen of the Westbury fire department] by
     5  the corporation in furtherance of its purposes as set forth pursuant  to
     6  section 625.1 of this act.
     7    §  625.5. Precept for payment of foreign fire insurance premium taxes.
     8  a.  Such corporation shall collect and there shall be paid to it all tax
     9  imposed by section [five hundred  and  fifty-three]  nine  thousand  one
    10  hundred  four of the insurance law, for fire department use and benefit,
    11  upon premiums for insurance against loss  or  damage  by  fire  covering
    12  property situated within the area protected by the Westbury fire depart-
    13  ment, and within any duly organized territory in which the Westbury fire
    14  department is, or may hereafter be, obligated to render fire protection.
    15    b.  The  officer  of  such  corporation  designated  by its by-laws to
    16  collect and receive the aforesaid tax shall  have  the  same  powers  as
    17  provided  by  law for the treasurer of a fire department with respect to
    18  such collection and receipt.
    19    c. Such corporation shall also be entitled to receive a share  of  the
    20  tax  imposed  by section [five hundred and fifty-four] nine thousand one
    21  hundred five of the insurance law, based upon premiums  written  in  the
    22  territory  with  respect  to which it is entitled to collect and receive
    23  the tax under section [five hundred and fifty-three] nine  thousand  one
    24  hundred four of the insurance law.
    25    d.  Such  taxes  shall  only  be used [for] by the [care and relief of
    26  disabled or indigent volunteer and exempt firemen  and  their  families]
    27  corporation  in  furtherance  of  its  purposes as set forth pursuant to
    28  section 625.1 of this act.
    29    § 2. This act shall take effect immediately.
