        AN ACT to amend the executive law, in relation to enrollment eligibility
          for certain persons in the address confidentiality program

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Short  title. This act shall be known and may be cited as
     2  the "address confidentiality for victims of kidnapping act".
     3    § 2. The opening paragraph, clause (A) of subparagraph  (i)  of  para-
     4  graph (a) of subdivision 2 and subdivision 3 of section 108 of the exec-
     5  utive  law,  as  amended by chapter 141 of the laws of 2019, are amended
     6  and a new paragraph (l) is added to subdivision 1 to read as follows:
     7    There is created in the office of the secretary of state a program  to
     8  be  known as the "address confidentiality program" to protect victims of
     9  domestic violence, victims of human trafficking, victims of  kidnapping,
    10  victims  of  a sexual offense and victims of stalking by authorizing the
    11  use of designated addresses for such victims and their  minor  children.
    12  The program shall be administered by the secretary of state.
    13    (l)  "Victim  of kidnapping" means a victim of any act constituting an
    14  offense as defined under sections 135.20 and 135.25 of the penal law.
    15    (A) the applicant, or the  minor  or  incapacitated  person  on  whose
    16  behalf the application is made, is a victim of domestic violence, victim
    17  of  human trafficking, victim of kidnapping, victim of a sexual offense,
    18  or victim of stalking;
    19    3. Designation of agencies to assist applicants. The  secretary  shall
    20  designate  state,  local  or nonprofit agencies that provide counseling,
    21  referral, shelter or other specialized services to victims  of  domestic
    22  violence,  victims  of human trafficking, victims of kidnapping, victims
    23  of a sexual offense and victims of stalking to assist  persons  applying
    24  to  be  program participants. Such persons providing assistance shall be
    25  trained by the secretary. Any assistance and counseling rendered  by  an

     1  officer  of the secretary or his or her designees to applicants shall in
     2  no way be construed as legal advice.
     3    §  3.  This  act shall take effect on the ninetieth day after it shall
     4  have become a law.
