AN ACT to amend the village law and the public officers law, in relation
to authorizing the village of Voorheesville to appoint certain village
officers who do not reside within such village
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Section 3-300 of the village law is amended by adding a new
2 subdivision 32 to read as follows:
3 32. Notwithstanding any provisions of this chapter or any other gener-
4 al law, local law, ordinance or special act, the village board of trus-
5 tees of the incorporated village of Voorheesville, Albany county, may,
6 by resolution, provide that the office of clerk, treasurer, clerk-trea-
7 surer, deputy clerk, deputy clerk treasurer, and building inspector of
8 the village of Voorheesville, Albany county, need not be a resident of
9 such village, but must be a resident of the county in which such village
10 is located or an adjoining county within the state of New York.
11 § 2. Section 3 of the public officers law is amended by adding a new
12 subdivision 72 to read as follows:
13 72. In the village of Voorheesville, in the county of Albany, the
14 provisions of this section requiring a person to be a resident of the
15 political subdivision or municipal corporation of the state for which he
16 or she shall be chosen or within which his or her official functions are
17 required to be exercised, shall not prevent a person from holding the
18 office of clerk, treasurer, clerk-treasurer, deputy clerk, deputy clerk
19 treasurer, and building inspector of the village of Voorheesville
20 provided that such person resides in the county in which such village is
21 located or an adjoining county within the state of New York. Provided,
22 however, the person performing the functions of an appointed village
23 officer in any other village shall be an elector of such village, unless
24 otherwise provided by law.
25 § 3. This act shall take effect immediately.
