          on Corporations, Authorities and Commissions
 
        AN  ACT to amend the public authorities law, in relation to establishing
          light duty during pregnancy and parental leave  for  certain  commuter
          rail service employees
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The public authorities law  is  amended  by  adding  a  new
     2  section 1266-l to read as follows:
     3    §  1266-l. Light duty for employees. 1. Should any employee engaged in
     4  the service of any commuter  rail  service  owned  or  operated  by  the
     5  authority  or its subsidiary, who is pregnant be prevented by such preg-
     6  nancy from performing the activities involved in  her  regular  assigned
     7  duties due, but is able, as determined by the employee's medical provid-
     8  er,  to  perform  specified types of light duty, the employer shall make
     9  available such light duty to the employee, provided, however, that  such
    10  light duty shall enable her to continue to be entitled to her concurrent
    11  assignment earnings, including increases thereof and fringe benefits, to
    12  which she would have been entitled if she were able to perform her regu-
    13  lar assigned duties.
    14    2.  Nothing  in  this  section shall be deemed to diminish the rights,
    15  privileges, or remedies of any employee under any collective  bargaining
    16  agreement or employment contract.
    17    § 2. This act shall take effect immediately.
