"This bill clarifies where a benefit has been determined to be medically necessary for the individual injured or the patient, no state department or agency can make a regulation that can deny payment for a service because someone else in the household may also benefit.  The new language makes it clear that the determining factor, the primary factor is whether the patient benefits and if so it may not prohibited where incidentally someone else benefits," said Asemblymember Abinanti on his legislation that makes modification to the Medical Indemnity Fund.  A378
