TITLE OF BILL:
An act to amend the administrative code of the city of New York, in
relation to prohibiting the issuance of tickets to residential occupants
for certain violations of the sanitation code
 
PURPOSE OR GENERAL IDEA OF BILL:
The purpose of this chapter amendment is to provide technical amendments
and establish an opt-in process for community boards to receive, in
those areas with Saturday trash collection, authorization for early
trash set out on Friday.
 
SUMMARY OF PROVISIONS:
Section one of this bill amends section 16-120(c) of the New York City
Administrative Code to provide an opt-in process for community boards to
receive, in those areas with Saturday trash collection, authorization
for early Friday trash set out. The New York City Department of Sanita-
tion would have 30 days from the community board's adoption of a resol-
ution to comply with such opt-in.
Section two provides the effective date for the chapter amendment.
 
JUSTIFICATION:
Chapter 705 of the Laws of 2025 prevents the New York City Department of
Sanitation from issuing any notice of violation, ticket or summons for
certain violations relating to placing solid waste or recyclable materi-
al out for collection earlier on Friday than would otherwise be allowed.
This chapter amendment modifies the original legislation to limit its
scope to those areas that have Saturday collection and for which the
community board has adopted a resolution.

This is a new bill.
 
FISCAL IMPLICATIONS:
None to the State.
 
EFFECTIVE DATE:
This act shall take effect on the same date and in the same manner as a
chapter of the laws of 2025 amending the administrative code of the city
of New York relating to prohibiting the issuance of tickets to residen-
tial occupants for certain violations of the sanitation code, as
proposed in legislative bills number S. 8256 and A.2693-A, takes effect.

AN ACT to amend the administrative code of the city of New York, in
relation to prohibiting the issuance of tickets to residential occu-
pants for certain violations of the sanitation code
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Paragraph 4 of subdivision c of section 16-120 of the
2 administrative code of the city of New York, as added by a chapter of
3 the laws of 2025 amending the administrative code of the city of New
4 York relating to prohibiting the issuance of tickets to residential
5 occupants for certain violations of the sanitation code, as proposed in
6 legislative bills numbers S. 8256 and A. 2693-A, is amended to read as
7 follows:
8 4. Notwithstanding any provision of this subdivision or any rule of
9 the department relating to collection to the contrary, the department
10 shall not issue a notice of violation, appearance ticket or summons to
11 any owner, lessee, tenant or occupant of a residential building or
12 dwelling, nor to a person who manages or controls such a building or
13 dwelling, for a violation of [paragraph (2) of subdivision e of this
14 section occurring between the hours of] this subdivision, or any rule
15 promulgated by the department, related exclusively to the time at which
16 solid waste or recyclable material is set out for collection, provided
17 that such set out occurs after 3:00 p.m. on Friday [and 6:00 p.m. on],
18 within an area of a community district that has Saturday [as a result of
19 placing refuse,] collection of solid waste or recyclable material, and
20 the associated community board has adopted a resolution requesting early
21 Friday set out of solid waste or recyclable material. The department
22 shall implement any community board requests within thirty days of a
23 resolution being adopted. Nothing in this paragraph shall otherwise be
24 construed to limit the ability of the department to promulgate rules
25 regarding the manner in which solid waste and recycling must be set out
26 for department collection [earlier than allowed under the rules of the
27 department relating to collection by the department or by a private
