AN ACT to amend the vehicle and traffic law, in relation to commercial
driving schools and private driving instruction
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The vehicle and traffic law is amended by adding a new
2 section 507-a to read as follows:
3 § 507-a. Commercial driving schools and private driving instruction.
4 1. Holders of valid learner's permits who have not completed an approved
5 driver education course in high school or college shall complete a mini-
6 mum of ten hours of road training experience conducted by an approved
7 commercial driving school or a private instructor consistent with regu-
8 lations and the provisions of this section.
9 2. All private driving instructors shall:
10 (a) hold a valid drivers' license issued by a state or territory of
11 the United States, or by the federal government; and
12 (b) provide notice to their insurance company of their intent to
13 provide driving instruction. Insurance companies shall issue an iden-
14 tification certificate which shall be presented to the department
15 inspector at the point of road test.
16 3. All commercial driving schools shall:
17 (a) require their instructors to hold a valid drivers' license issued
18 by a state or territory of the United States, or by the federal govern-
19 ment;
20 (b) provide notice to each instructor's insurance company of his or
21 her intent to provide driving instruction. Insurance companies shall

1 issue an identification certificate which shall be presented to the
2 department inspector at the point of the road test;
3 (c) equip all instructional vehicles with dual brake systems;
4 (d) post a bond in the amount of fifteen thousand dollars prior to
5 enrolling any students;
6 (e) provide handicap accessibility entrances for attendees at five-
7 hour pre-licensing classes and defensive driving courses offered on
8 site;
9 (f) maintain a minimum of two vehicles;
10 (g) provide proof of a minimum of twenty-thousand driving hours by the
11 school's principal owner; and
12 (h) be located no closer than forty city blocks from another commer-
13 cial driving school.
14 § 2. This act shall take effect on the one hundred eightieth day after
15 it shall have become a law; provided, however, that effective immediate-
16 ly, the addition, amendment and/or repeal of any rule or regulation
17 necessary for the implementation of this act on its effective date is
18 authorized and directed to be made and completed on or before such
19 effective date.
