        Introduced  by M. of A. MAGNARELLI, GUNTHER, JAFFEE, CASTRO -- read once
          and referred to the Committee on Judiciary
 
        AN ACT to amend the public officers law, in relation to  filling  vacan-
          cies in the office of lieutenant-governor
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The public officers law is amended by adding a new  section
     2  44 to read as follows:
     3    §  44. Filling vacancies in the office of lieutenant-governor. In case
     4  of vacancy in the office of lieutenant-governor  alone,  due  to  death,
     5  resignation,  removal  from office, or ascension to governor, the office
     6  of lieutenant-governor shall be filled for the remainder of the term  by
     7  appointment  of  the governor within thirty days of such vacancy, death,
     8  resignation, removal from office, or ascension, subject to  confirmation
     9  by  a majority vote in the senate and a majority vote in the assembly to
    10  be held within thirty days of such appointment.

    11    § 2. This act shall take effect immediately.
