        AN ACT to amend the public health law,  in  relation  to  extending  the

          number  of  days  within  a twelve month period a facility may receive
          reimbursement for a reserved bed
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Subparagraph  (iii) of paragraph (b) of subdivision 25 of
     2  section 2808 of the public health law, as amended by section 34 of  part
     3  D of chapter 56 of the laws of 2012, is amended to read as follows:
     4    (iii)  payment  to a facility for reserved bed days provided on behalf
     5  of such person for non-hospitalization leaves of absence may not  exceed
     6  ten  days  in  any twelve month period.   Provided, however, should such
     7  person's individual care plan provide for therapeutic leave, payment  to
     8  a  facility for reserve bed days on behalf of such person for non-hospi-

     9  talization leaves may not exceed twenty-five days in  any  twelve  month
    10  period.
    11    § 2. This act shall take effect immediately.
