        AN ACT to amend the New York state printing and public documents law and
          the state technology law, in relation to agency reports
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1. Subdivision 4 of section 12 of the New York state printing
     2  and public documents law, as amended by chapter 278 of the laws of 2012,
     3  is amended to read as follows:
     4    4. (a) Whenever state law requires a  state  agency  to  make,  issue,
     5  submit,  deliver, distribute or forward a report to the "legislature" or
     6  to "members of the legislature" or to "both houses of the  legislature,"
     7  or to any particular legislative officers or chairpersons of legislative
     8  committees,  subcommittees or commissions, the agency shall satisfy such
     9  requirement by:

    10    (i) [making, issuing, submitting, delivering, distributing or forward-
    11  ing a printed copy of the report to each member of the  legislature,  or
    12  to  the  specified legislative officers or chairpersons, as the case may
    13  be; if such report contains confidential information or is provided with
    14  the understanding that further disclosure of certain information in such
    15  reports is prohibited, provided that, such report shall be posted to the
    16  agency's website with all such confidential  information  redacted;  or]
    17  making  such  document  available on the New York state agency documents
    18  website, as authorized by subdivision twenty-two of section one  hundred
    19  three  of the state technology law, under the appropriate agency's head-

    20  ing and sending a printed letter or notice to each member of the  legis-
    21  lature, or to the specified legislative officers or chairpersons, as the

     1  case may be, indicating the availability of such report on this website;
     2  and
     3    (ii)  making  such  document  available  on  its website and sending a
     4  printed letter or notice to each member of the legislature,  or  to  the
     5  specified  legislative  officers  or  chairpersons,  as the case may be,
     6  indicating the availability of such report on the agency's website.

     7    (b) Such letter or notice shall  include  the  name  of  the  specific
     8  report,  the specific web address at which the report can be accessed or
     9  instructions on how to access the report from the agency's homepage, and
    10  the name of the person at the state agency to whom  the  legislator  may
    11  direct a request to obtain a printed copy of the report, free of charge,
    12  if so desired.
    13    §  2.  Section  103 of the state technology law is amended by adding a
    14  new subdivision 22 to read as follows:
    15    22. To establish, administer and maintain  a  New  York  state  agency
    16  documents  website  which will include postings of all reports issued by
    17  state agencies, departments, public authorities, public  benefit  corpo-
    18  rations  or entities whenever state law requires a state agency to make,

    19  issue, submit, deliver, distribute or forward a report to the  "legisla-
    20  ture"  or  to  "members  of  the  legislature" or to "both houses of the
    21  legislature", or to any particular legislative officers or  chairpersons
    22  of legislative committees, subcommittees or commissions. It shall be the
    23  responsibility  of  the New York state agency documents website to serve
    24  as the central repository for the posting and archiving of all documents
    25  provided to the legislature as required by state law.
    26    § 3. This act shall take effect on the one hundred twentieth day after
    27  it shall have become a law.
