        AN  ACT  to amend the vehicle and traffic law, in relation to the idling
          of motor vehicles while waiting to board a ferry
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 

     1    Section  1.  Section  375 of the vehicle and traffic law is amended by
     2  adding a new subdivision 52 to read as follows:
     3    52. (a) No person who owns, operates or leases a motor  vehicle  shall
     4  allow  or  permit the engine of such motor vehicle to idle while waiting
     5  to board a ferry or within one hundred feet of a ferry terminal.
     6    (b) The following are exempt from the provisions of this subdivision:
     7    (i) Fire, police and public utility trucks or other vehicles  perform-
     8  ing emergency services;
     9    (ii)  A  hybrid electric vehicle, as defined in NYCRR6, idling for the
    10  purpose of providing energy for battery or other form of energy  storage
    11  recharging; and
    12    (iii) Electric powered vehicles.

    13    (c)  The  commissioner, in conjunction with the commissioner of parks,
    14  recreation and historic preservation,  shall  require  every  ferry  and
    15  ferry  terminal to conspicuously post not less than two signs, of a size
    16  and design designated by such commissioners. Such sign shall include the
    17  following words: "NO IDLING OF MOTOR VEHICLES pursuant to the  New  York
    18  State  Vehicle  and  Traffic  Law  and  the Rules and Regulations of the
    19  Commissioner of Motor Vehicles".
    20    § 2. This act shall take effect on the first of January next  succeed-
    21  ing  the  date  on which it shall have become a law. The commissioner of
    22  motor vehicles shall promulgate rules and regulations as  are  necessary
    23  to effectuate the implementation of this act and shall assign points for

    24  violations of section one of this act as the commissioner of motor vehi-
    25  cles deems appropriate.
