LUPARDO -- read once and referred to the Commit- tee on Codes AN ACT to amend the criminal procedure law, in relation to the payment of certain fines and mandatory surcharges The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 420.10 of the criminal procedure law is amended by 2 adding a new subdivision 9 to read as follows: 3 9. When the court imposes upon an individual both (a) a fine for an 4 offense specified in subdivision nine of section eighteen hundred three 5 of the vehicle and traffic law, and (b) a mandatory surcharge set forth 6 in paragraph (b) of subdivision one of section eighteen hundred nine of 7 the vehicle and traffic law, section eighteen hundred nine-c of the 8 vehicle and traffic law or section eighteen hundred nine-e of the vehi- 9 cle and traffic law, and imposes a schedule of payments, the court shall 10 also direct that payment of the fine take priority over the payment of 11 any such surcharge. 12 § 2. This act shall take effect on the first of November next succeed- 13 ing the date on which it shall have become a law.
