AN ACT to amend the general municipal law, in relation to prohibiting
the location of an adult entertainment business within one thousand
feet of certain public places
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The general municipal law is amended by adding a new arti-
2 cle 13-E to read as follows:
3 ARTICLE 13-E
4 ADULT ENTERTAINMENT BUSINESSES; LOCATION
5 Section 300. Adult entertainment businesses; location.
6 § 300. Adult entertainment businesses; location. The operation of an
7 adult entertainment business within one thousand feet of any public
8 place of worship, any school or bus stop, any municipal or county play-
9 ground or place designated for public recreation, or any area zoned for
10 residential use is prohibited, unless expressly permitted by ordinance
11 of the governing body of the municipality exercising zoning jurisdiction
12 over the geographic area. For the purpose of this section, "adult enter-
13 tainment business" shall include but not be limited to adult arcades,
14 adult bookstores or video stores, adult paraphernalia stores, adult
15 cabarets, adult live entertainment establishments, adult motion picture
16 theaters, adult theaters, massage establishments that offer adult
17 service or nude model studios.
18 § 2. This act shall take effect on the one hundred eightieth day after
19 it shall have become a law.
