AN ACT to amend the correction law, in relation to addiction counseling
services for inmates
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The correction law is amended by adding a new section 626
2 to read as follows:
3 § 626. Addiction counseling program. The commissioner, in conjunction
4 with the office of alcoholism and substance abuse services, shall estab-
5 lish a program to be administered at correctional facilities within the
6 department in the state, for the purpose of offering addiction coun-
7 seling services for any inmate in such facilities suffering from a
8 substance use disorder. After a medical screening, inmates who are
9 determined to suffer from a substance use disorder shall be offered
10 placement in an addiction counseling program. Placement in such program
11 shall not be mandatory. Each participating inmate shall work with an
12 authorized specialist to determine an individualized treatment plan,
13 including an appropriate level of counseling.
14 § 2. Section 45 of the correction law is amended by adding a new
15 subdivision 18 to read as follows:
16 18. Establish standards and guidelines for a program of addiction
17 counseling services for inmates in county jails and/or county correc-
18 tional facilities equivalent to the program established in state correc-
19 tional facilities pursuant to section six hundred twenty-six of this
20 chapter.
21 § 3. This act shall take effect immediately.
