AN ACT to amend the education law, in relation to requirements associ-
ated with the New York city community school district system and the
length of certain council members' terms
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subparagraph 1 of paragraph (a) of subdivision 1 of section
2 2590-b of the education law is amended by adding a new clause (D) to
3 read as follows:
4 (D) Commencing on July first, two thousand twenty-three, the board of
5 education shall consist of fifteen members: one member to be appointed
6 by each borough president of the city of New York, one member to be
7 elected by community district education and city-wide council presi-
8 dents, and nine members to be appointed by the mayor of the city of New
9 York. On or before March thirty-first, two thousand twenty-three, the
10 chancellor shall promulgate regulations establishing a process for
11 community district education and city-wide council presidents to elect a
12 member of the board, and processes for removal of such member and for
13 the filling of such position in the event of a vacancy. The first member
14 elected by community district education and city-wide council presidents
15 pursuant to such regulations shall take office on July first, two thou-
16 sand twenty-three and shall serve a term that ends on June thirtieth,
17 two thousand twenty-five. Thereafter, the member elected by community
18 district education and city-wide council presidents shall serve for a
19 two year term commencing on July first.
20 § 2. Subparagraph 1 of paragraph a of subdivision 4 of section 2590-b
21 of the education law, as amended by chapter 345 of the laws of 2009, is
22 amended to read as follows:
23 (1) nine voting members who shall be parents of students with individ-
24 ualized education programs, to be selected by parents of students with

1 individualized education programs pursuant to a representative process
2 developed by the chancellor. Such members shall serve a two year term
3 and shall be eligible to continue serving their term following the
4 conclusion of their child's individualized education program;
5 § 3. Subparagraph (i) of paragraph (a) of subdivision 5 of section
6 2590-b of the education law, as amended by chapter 103 of the laws of
7 2013, is amended to read as follows:
8 (i) nine voting members who shall be parents of students who [are] at
9 any time in the past enrolled in a bilingual or English as a second
10 language program conducted pursuant to section thirty-two hundred four
11 of this chapter[, some of whom may be parents of students who have been
12 in such a program within the preceding two years], to be selected by
13 parents of students who receive or have ever received such services
14 pursuant to a representative process developed by the chancellor. Such
15 members shall serve a two year term and shall be eligible to continue
16 serving their term following the conclusion of their child's enrollment
17 in a bilingual or English as a second language program;
18 § 4. Subparagraph (i) of paragraph (a) of subdivision 6 of section
19 2590-b of the education law, as amended by section 43-g of part YYY of
20 chapter 59 of the laws of 2019, is amended to read as follows:
21 (i) ten voting members who shall be parents of students attending
22 public high schools. For councils whose terms begin prior to two thou-
23 sand twenty, two members representing each borough shall be selected by
24 presidents and officers of the parents' associations or parent-teachers'
25 associations in the relevant borough, pursuant to a process established
26 by the chancellor. For councils whose terms begin in two thousand twen-
27 ty-one [and thereafter], two members representing each borough shall be
28 parents of public high school students in the relevant borough, pursuant
29 to a process established by the chancellor. Such members shall serve a
30 two year term, and shall be eligible to continue serving their term
31 following the conclusion of their child's attendance at a public high
32 school. For councils whose terms begin in two thousand twenty-three and
33 thereafter, two members representing each borough shall be selected by
34 parents of public high school students in the relevant borough, pursuant
35 to a process established by the chancellor. Such members shall serve a
36 two year term, and shall be eligible to continue serving their term
37 following the conclusion of their child's attendance at a public high
38 school;
39 § 5. Subparagraph (iii) of paragraph (a) of subdivision 6 of section
40 2590-b of the education law, as added by chapter 345 of the laws of
41 2009, is amended to read as follows:
42 (iii) one voting member who shall be a parent of a student who at any
43 time in the past enrolled in a bilingual or English as a second language
44 program conducted in a public high school. Such member shall be
45 appointed by the city-wide council on English language learners, and
46 shall serve a two year term;
47 § 6. This act shall take effect immediately, provided, however, that
48 the amendments to section 2590-b of the education law made by sections
49 one, two, three, four and five of this act shall not affect the expira-
50 tion or repeal of such provisions and shall expire and be deemed
51 repealed therewith.
