        AN ACT to amend the elder law, in relation to  establishing  a  dementia
          and Alzheimer's disease program database
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. The elder law is amended by adding a  new  section  224  to
     2  read as follows:
     3    §  224.  Dementia  and Alzheimer's disease program database. 1.  Defi-
     4  nitions. For the purposes of this section, the terms:
     5    (a) "Elderly persons" shall mean individuals aged sixty years  of  age
     6  or older.
     7    (b)  "Programs"  shall  mean programs, methodologies, or services that
     8  are provided by a public, governmental, non-profit, or for-profit agency
     9  to elderly persons in their home or in a community setting.
    10    2. The office, in conjunction with the  department  of  health,  shall
    11  develop  and  maintain a database of programs that have been shown to be
    12  successful in supporting and treating  elderly  persons  suffering  from
    13  dementia or Alzheimer's disease.
    14    (a)  The  director,  in  conjunction  with the commissioner of health,
    15  shall develop criteria to determine if a  program  shall  be  considered
    16  successful and be included in the database.
    17    (b)  The director, in conjunction with the commissioner of health, may
    18  consult with public, governmental, non-profit, and  for-profit  agencies
    19  to determine which programs are considered successful.
    20    3.  The database created pursuant to this section shall be made avail-
    21  able on the office's website. The information  from  the  database  that
    22  shall be accessible to the public shall include but not be limited to:
    23    (a)  contact  information  for  the  person or entity through whom the
    24  program is provided;
    25    (b) the name of the program, where applicable;

     1    (c) a brief description of the program; and
     2    (d) the geographic area in which the program is provided or offered.
     3    4.  The  database created pursuant to this section shall be updated by
     4  the office, in conjunction with the department of health, at least  once
     5  annually.
     6    §  2. This act shall take effect one year after it shall have become a
     7  law; provided, however, that the addition, amendment  and/or  repeal  of
     8  any  rule  or regulation necessary for the implementation of this act on
     9  its effective date is authorized and directed to be made  and  completed
    10  on or before such effective date.
