        AN  ACT  to  amend  the  executive  law  and  the mental hygiene law, in
          relation to requiring training for probation and  parole  officers  in
          substance abuse and making an appropriation therefor
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1.  Section 243 of the executive law is amended  by  adding  a
     2  new subdivision 5 to read as follows:
     3    5.  The  director shall provide substance abuse training and education
     4  programs for probation officers. Such training shall include, but not be
     5  limited to: identification of controlled substances;  identification  of
     6  the  physical signs of substance abuse/use; an awareness and understand-
     7  ing of the impact of substance abuse/use on the  family  unit;  and  the
     8  availability  of  drug  treatment,  prevention,  education services, and
     9  appropriate referrals. Such program shall be  conducted  in  conjunction

    10  with the office of alcoholism and substance abuse services.
    11    §  2.    Section 259-a of the executive law is amended by adding a new
    12  subdivision 11 to read as follows:
    13    11. The division shall provide substance abuse training and  education
    14  programs  for  parole  officers. Such training shall include, but not be
    15  limited to: identification of controlled substances;  identification  of
    16  the physical signs of substance abuse/use; an awareness of the impact of
    17  substance  abuse/use  on  the  family unit; and the availability of drug
    18  treatment, prevention, education services,  and  appropriate  referrals.
    19  Such  program shall be conducted in conjunction with the office of alco-
    20  holism and substance abuse services.

    21    § 3. Section 19.07 of the mental hygiene law is amended  by  adding  a
    22  new subdivision (i) to read as follows:
    23    (i) The office of alcoholism and substance abuse services shall devel-
    24  op  a substance abuse training education program in conjunction with the

     1  division of parole and the division of probation and correctional alter-
     2  natives to provide substance abuse training and education as provided in
     3  sections two hundred forty-three and two  hundred  fifty-nine-a  of  the
     4  executive law.

     5    §  4.  The sum of five hundred thousand dollars ($500,000), or so much
     6  thereof as may be necessary, is hereby appropriated  to  the  office  of
     7  alcoholism  and  substance  abuse  services from any moneys in the state
     8  treasury in the general fund to the credit of the state purposes account
     9  not otherwise appropriated for services and expenses of the said  office
    10  for  the  purposes  of carrying out the provisions of this act. Such sum
    11  shall be payable on the audit and warrant of the  state  comptroller  on
    12  vouchers  certified  or  approved by the commissioner of said office, or
    13  his duly designated representative in the manner  provided  by  law.  No
    14  expenditure shall be made from this appropriation until a certificate of
    15  approval  of  availability shall have been issued by the director of the
    16  budget and filed with the state comptroller and a copy  filed  with  the

    17  chairman  of the senate finance committee and the chairman of the assem-
    18  bly ways and means committee.  Such certificate may be amended from time
    19  to time by the director of the budget and a copy of each such  amendment
    20  shall  be  filed  with the state comptroller, the chairman of the senate
    21  finance committee and the  chairman  of  the  assembly  ways  and  means
    22  committee.
    23    § 5. This act shall take effect immediately.
