        AN  ACT  to amend the vehicle and traffic law, in relation to the regis-
          tration of vintage snowmobiles
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 

     1    Section  1.  Section 2222 of the vehicle and traffic law is amended by
     2  adding a new subdivision 4-b to read as follows:
     3    4-b. (a) Fees for vintage snowmobiles. Notwithstanding any other  law,
     4  rule  or  regulation to the contrary, fees for registration of a vintage
     5  snowmobile which is owned and operated as an exhibition piece or collec-
     6  tor's item, and is used for participation in club activities,  exhibits,
     7  tours, parades, occasional transportation and similar uses, but not used
     8  for  general  snowmobiling purposes, shall be as follows (i) ten dollars
     9  annually if the registrant is a member of an organized club as set forth
    10  in subdivision four-a of this section, and (ii) twenty dollars  annually
    11  if  the  registrant  is  not  a member of such a club; provided that the

    12  registrant of a vintage snowmobile shall not be  subject  to  the  addi-
    13  tional  fees  set out in subdivision four-a of this section, and section
    14  21.07 of the parks, recreation and historic preservation law.
    15    (b) The registration sticker for vintage snowmobiles  which  shall  be
    16  used  only  for  vintage  snowmobiles shall be of a different color than
    17  other registration stickers for snowmobiles.  Such registration  sticker
    18  shall  not  be  required  to  be affixed to the snowmobile, but shall be
    19  required to be readily available to the operator and presented on demand
    20  by a law enforcement officer.
    21    (c) For purposes of this subdivision, a vintage snowmobile shall  mean
    22  any  snowmobile  manufactured  thirty or more years prior to the current

    23  calendar year, and any other model, year and type snowmobile  which  has
    24  unique characteristics and which is determined by the commissioner to be
    25  of historical, classic or exhibition value.

     1    (d)  A person who owns or operates a snowmobile which is registered as
     2  a vintage snowmobile and such snowmobile is not a vintage snowmobile  as
     3  defined  in  paragraph  (c)  of  this  subdivision  shall be guilty of a
     4  violation and shall be subject to a fine of two hundred dollars.

     5    §  2.  This  act shall take effect on the ninetieth day after it shall
     6  have become a law, provided that the commissioner of motor  vehicles  is
     7  immediately  authorized  and  directed  to  promulgate and/or repeal any
     8  rules and regulations necessary to implement the provisions of this  act
     9  on its effective date.
