        Introduced  by  M.  of A. BRODSKY, GOTTFRIED, CANESTRARI, GLICK, LIFTON,
          PAULIN, PHEFFER, CHRISTENSEN, BRADLEY, GALEF, PRETLOW -- read once and
          referred to the Committee on Health
 
        AN ACT to amend the public health law, in relation to supplemental indi-
          gent care allocations to high-need diagnostic and treatment centers
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  2807-p  of  the  public health law is amended by
     2  adding a new subdivision 4-d to read as follows:
     3    4-d.  (a) For periods on and after  July  first,  two  thousand  nine,
     4  funds  shall  be made available in the following amounts for payments to
     5  eligible voluntary non-profit  diagnostic  and  treatment  centers  that
     6  demonstrate that a minimum of twenty-five percent of total clinic visits
     7  reported  during the applicable base year period were to uninsured indi-
     8  viduals:
     9    (i) For the period July first,  two  thousand  nine  through  December
    10  thirty-first, two thousand nine, three million dollars;

    11    (ii)  For  the period January first, two thousand ten through December
    12  thirty-first, two thousand ten, six million dollars; and
    13    (iii) For the period January first, two thousand eleven  through  June
    14  thirtieth, two thousand eleven, three million dollars.
    15    (b)  Funds  allocated for payments in accordance with this subdivision
    16  shall be distributed as follows: the amount distributed to a  diagnostic
    17  and  treatment  center eligible for distributions under this subdivision
    18  shall be based on such diagnostic and treatment  center's  uncompensated
    19  nominal need compared to the aggregate uncompensated nominal need of all
    20  diagnostic  and  treatment centers eligible for distributions under this

    21  subdivision. Uncompensated nominal need shall be calculated as the nomi-
    22  nal payment amount established for such center in accordance with  para-
    23  graph  (b)  of  subdivision  four  of  this  section  less the aggregate
    24  payments received by such center in accordance with  subparagraph  (iii)
    25  of paragraph (a) and paragraph (c) of subdivision four of this section.
    26    § 2. This act shall take effect immediately.
