        Introduced  by M. of A. BRODSKY -- read once and referred to the Commit-
          tee on Governmental Operations
 
        AN ACT to amend the public officers law, in relation to willful  failure
          to make timely disclosure of a public record
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 

     1    Section 1. Section 89 of the public officers law is amended by  adding
     2  a new subdivision 10 to read as follows:
     3    10. Any officer or employee of a state agency charged with the disclo-
     4  sure  of  any  record  in compliance with the provisions of this article
     5  shall make such disclosure within the  time  periods  provided  in  this
     6  section.  Any  agency which employs a person who has willfully failed to
     7  make timely disclosure of such record shall be subject to a civil penal-
     8  ty in an amount not to exceed one thousand dollars.
     9    § 2. This act shall take effect on the ninetieth day  after  it  shall
    10  have become a law.
