        Introduced  by M. of A. TOWNS, KOLB, WALKER -- read once and referred to
          the Committee on Education
 
        AN ACT to amend the education law, in relation to school district  resi-
          dency  requirements  for students whose parents are activated to mili-
          tary service
 
          The People of the State of New York, represented in Senate and  Assem-

        bly, do enact as follows:
 
     1    Section  1.  Subdivision  2  of  section  3202 of the education law is
     2  amended to read as follows:
     3    2. Nonresidents of a district, if otherwise competent, may be admitted
     4  into the school or schools of a district or city, upon  the  consent  of
     5  the  trustees  or  the board of education, upon terms prescribed by such
     6  trustees or board.  Notwithstanding any other provision of  law  to  the
     7  contrary,  nonresident  status  shall  not apply to a student who subse-
     8  quently becomes a nonresident because he or she must reside  outside  of
     9  his  or her school district temporarily while one or both parents are in
    10  active military service.
    11    § 2. This act shall take effect immediately.
