        AN ACT to amend the workers' compensation law, in relation to  including
          exposure to novel coronavirus, COVID-19 as an occupational disease
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Paragraph 30 of subdivision 2 of section 3 of the  workers'
     2  compensation  law  is  renumbered paragraph 31 and a new paragraph 30 is
     3  added to read as follows:
     4  30. Novel coronavirus,   30. Any and all work that causes workers to
     5  COVID-19 exposure.       be in contact with the public, patients,
     6                           inmates, residents, parolees,
     7                           clients, students, customers,
     8                           diners, persons in the
     9                           custody of the state or any
    10                           of its political subdivisions,
    11                           or travelers during an outbreak of the novel
    12                           coronavirus, COVID-19; or any
    13                           and all work that could
    14                           expose workers to novel
    15                           coronavirus, COVID-19, which
    16                           shall include, but not be limited to,
    17                           work in a hospital,
    18                           medical facility, laboratory,
    19                           medical office, nursing
    20                           home, correctional facility,
    21                           mental health facility, social
    22                           services facility, airport,
    23                           bus station, train station,
    24                           subway station, park, restaurant,
    25                           cafeteria, retail

         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1                           facility, airplane, bus, train,
     2                           subway, university, college,
     3                           school, daycare facility,
     4                           childcare facility, hotel, resort,
     5                           casino, convention center,
     6                           meeting facility or work for a
     7                           public utility, work for any businesses
     8                           deemed to provide essential services
     9                           during an outbreak of the
    10                           novel coronavirus, COVID-19, any work outside
    11                           the home during a period of closure
    12                           of non-essential businesses, or public
    13                           employment during an outbreak of
    14                           the novel coronavirus, COVID-19.
    15    §  2. The closing paragraph of subdivision 2 of section 3 of the work-
    16  ers' compensation law, as amended by chapter 666 of the laws of 1971, is
    17  amended to read as follows:
    18    Nothing in paragraph [thirty] thirty-one of this subdivision shall  be
    19  construed  to  apply  to  any  disability  or  death  due to any disease
    20  described in paragraph twenty-nine of this subdivision.
    21    § 3. This act shall take effect immediately.
