        AN ACT in relation to creating a temporary state commission to develop a

          "made  in New York" program for the purpose of fostering the growth of
          business and industry in New York state and providing for  the  repeal
          of such provisions upon expiration thereof
 
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Legislative intent. The legislature hereby finds that thir-
     2  ty years ago, New York state was the largest manufacturing state in  the
     3  country.  The  legislature  recognizes that New York state is one of the
     4  largest consumers of manufactured goods in the world;  recognizing  that
     5  many  of our social problems and dependence on government is a result of
     6  the destruction of such manufacturing center;  and  recognizing  that  a
     7  strong  employment  sector  will  allow  New  York  state to advance the

     8  welfare of all of its citizens. The legislature finds that it is  there-
     9  fore  necessary and imperative that the legislature develop a comprehen-
    10  sive strategy to rebuild New York state's durable and non-durable  manu-
    11  facturing  base.  It is therefore the intent of the legislature that the
    12  "made in New York" program be the vehicle to accomplish this objective.
    13    § 2. A  temporary  state  commission  is  hereby  created  to  develop
    14  programs  and  policies  for  the purpose of enhancing and fostering the
    15  introduction, expansion and growth of business and industry in New  York
    16  state.  Such  commission  shall  develop  a  "made  in New York" program
    17  including, but not limited, to the following:
    18    (a) Choose target industries which would have a positive effect on New
    19  York state and its residents and would be beneficial  to  the  financial
    20  well being of this state.

     1    (b)  Develop  voluntary  programs  with  New  York  state colleges and
     2  universities to train students to work in  the  selected  target  indus-
     3  tries, including specific education in starting and running a business.
     4    (c)  Create  a tax credit or other similar incentive for employers who
     5  hire students from these programs  including  full-time,  part-time  and
     6  summer employment.
     7    §  3. The commission shall consist of fourteen members to be appointed
     8  as follows: the commissioner of economic development;  the  commissioner

     9  of labor; a representative of the SUNY system; a representative from the
    10  independent  colleges  and  universities in New York state; four persons
    11  appointed by the governor including one from a labor  interest  and  one
    12  from  business;  two persons appointed by the temporary president of the
    13  senate; two appointed by the speaker of the assembly; one  appointed  by
    14  the  minority  leader  in  the  senate and one appointed by the minority
    15  leader in the assembly. The governor  shall  designate  the  chairperson
    16  from  among  his  appointees.  Vacancies  shall  be filled in the manner
    17  provided for original appointments.
    18    § 4. The commission may meet within and without the state, shall  hold
    19  public  hearings, and shall have all the powers of a legislative commit-
    20  tee pursuant to the legislative law.
    21    § 5. The members of the commission  shall receive no compensation  for

    22  their services, but shall be allowed their actual and necessary expenses
    23  incurred in the performance of their duties hereunder.
    24    §  6. To the maximum extent feasible, the commission shall be entitled
    25  to request and receive and shall  utilize  and  be  provided  with  such
    26  facilities,  resources,  and  data  of  any court, department, division,
    27  board, bureau, commission, or agency  of  the  state  or  any  political
    28  subdivision  thereof  as it may reasonably request to carry out properly
    29  its powers and duties hereunder.
    30    § 7. The commission shall make a preliminary report to the legislature
    31  of its conclusions and recommendations, including legislative  proposals
    32  necessary  to  implement  the suggested programs, not later than June 1,
    33  2009.
    34    § 8. This act shall take effect immediately and shall remain in effect

    35  until June 1, 2011, when upon such date the provisions of this act shall
    36  expire and be deemed repealed.
