        AN  ACT  to amend the environmental conservation law, in relation to the
          management of weakfish
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.   Section 13-0340-a of the environmental conservation law,
     2  as amended by chapter 152 of the laws of 2007, is  amended  to  read  as
     3  follows:
     4  § 13-0340-a. Weakfish (Cynoscion regalis).
     5    The department may, until December thirty-first, two thousand [eleven]
     6  fourteen,  fix  by  regulation  measures  for the management of weakfish
     7  (Cynoscion regalis), including size limits, catch and possession limits,
     8  open and closed seasons, closed areas, restrictions  on  the  manner  of
     9  taking  and  landing, requirements for permits and eligibility therefor,
    10  recordkeeping requirements, requirements on the amount and type of fish-
    11  ing effort  and  gear,  and  requirements  relating  to  transportation,

    12  possession and sale, provided that such regulations are no less restric-
    13  tive  than  requirements  set forth in this chapter and provided further
    14  that such regulations are consistent with the compliance requirements of
    15  applicable fishery management  plans  adopted  by  the  Atlantic  States
    16  Marine  Fisheries  Commission  and with applicable provisions of fishery
    17  management plans adopted pursuant to the  Federal  Fishery  Conservation
    18  and Management Act (16 U.S.C. § 1800 et seq.).
    19    § 2. This act shall take effect immediately.
