JOYNER, GOTTFRIED -- read once and referred to the Committee on Health -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public health law, in relation to the establishment of obstetric hemorrhage protocols The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 1 of section 2803-n of the public health law is 2 amended by adding a new paragraph (c) to read as follows: 3 (c) (i) The commissioner shall provide guidance to hospitals on 4 obstetric hemorrhage protocols, in consultation with clinical experts, 5 and develop or identify an existing toolkit on obstetric hemorrhage 6 management, which may include a hemorrhage care checklist for use by 7 hospitals as part of the protocols and guidance on simulation training. 8 The commissioner shall report to the temporary president of the senate 9 and the speaker of the assembly on data reported to the department under 10 this paragraph within two years from the effective date of this para- 11 graph, and every two years thereafter. 12 (ii) The hospital shall adopt, implement, periodically update and 13 submit to the department standard protocols for management of obstetric 14 hemorrhage. Such protocols shall address early recognition and assess- 15 ment, readiness to respond in a multidisciplinary manner, and data 16 reporting to the department sufficient for the department to monitor and 17 report pursuant to this paragraph. Such protocols shall utilize risk 18 assessment tools such as the toolkit established or identified by the 19 department under this paragraph and shall include a response plan 20 providing for the triage and transfer to higher level facilities if 21 needed. 22 § 2. This act shall take effect six months after it shall have become 23 a law. Effective immediately, the commissioner of health shall make 24 regulations and take other actions reasonably necessary to implement 25 this act on that date.
