SALADINO -- read once and referred to the Commit- tee on Correction AN ACT to amend the correction law, in relation to credit for jail time The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The opening paragraph of section 600-a of the correction 2 law is designated subdivision 1 and a new subdivision 2 is added to read 3 as follows: 4 2. Credit for time served shall not be granted to a defendant who has 5 failed to appear at any time at the direction of the court in the 6 proceeding. The defendant will be given an opportunity to explain the 7 reason for such failure to appear and may, at the discretion of the 8 court, be granted a part or all of such time served if the failure to 9 appear was beyond the control of the defendant. 10 § 2. This act shall take effect immediately, and shall apply to 11 sentences pronounced on and after such effective date.
