        Introduced  by M. of A. TOBACCO, ALFANO, BURLING, KOLB, TOWNSEND -- read
          once and referred to the Committee on Governmental Employees
 
        AN ACT to amend the administrative code of the  city  of  New  York,  in
          relation  to  allowing  garnishment of pensions from the New York city
          police pension fund by the estate of a person murdered by the retiree
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  Section  13-264 of the administrative code of the city of
     2  New York is amended by  adding  a  new  closing  paragraph  to  read  as
     3  follows:
     4    Notwithstanding  the foregoing provisions of this section or any other
     5  law, rule or regulation to the contrary, the benefits being received  by
     6  a  person  as  a  retiree from the New York city police pension fund are
     7  subject to execution, garnishment, attachment or any  other  process  to
     8  satisfy  a  judgment against the retiree receiving the benefits obtained
     9  by the estate of a victim who was  murdered  by  such  retiree  who  was
    10  convicted of such murder including a judgement obtained as the result in

    11  a  wrongful  death action by the estate of such victim against the reti-
    12  ree.
    13    § 2. This act shall take effect immediately.
