AN ACT to amend chapter 4 of the laws of 1977, relating to incorporating
the "Wallkill hook ladder and hose company firemen's benevolent asso-
ciation", and providing for its powers and duties, in relation to the
purposes thereof and use of taxes therefor
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Sections 3 and 7 of chapter 4 of the laws of 1977, relating
2 to incorporating the "Wallkill hook ladder and hose company firemen's
3 benevolent association", and providing for its powers and duties, are
4 amended to read as follows:
5 § 3. Purposes. [The purposes of such corporation shall be the mainte-
6 nance of suitable headquarters for, and the promotion of friendly asso-
7 ciation for the betterment of the members of such corporation and their
8 relations with the community, for the promotion of fraternal intercourse
9 among the members of such corporation, to study and disseminate among
10 the members of such corporation the most efficient manner of fighting
11 fires and the relief, aid and assistance of such members and their fami-
12 lies who are disabled or indigent and to acquire real and personal prop-
13 erty such as may be necessary for the purposes herein set forth and the
14 promotion of the welfare of the volunteer fire service within the terri-
15 tory now served or which may hereafter be served by the Wallkill hook
16 ladder and hose company incorporated.] The purposes of the corporation
17 created by this act shall be: to provide relief, aid and assistance to
18 the volunteer members of such corporation who are indigent, disabled, or
19 injured in the performance of their duties, and to provide such relief,
20 aid and assistance to their families; to maintain a suitable headquar-
21 ters for the volunteer members of such corporation, and their families;
22 to provide for the health and safety of the volunteer members of such

1 corporation; to enhance the morale of the volunteer members of such
2 corporation by providing social and recreational activities for such
3 volunteer members; and to provide for the promotion of the volunteer
4 fire service within the territory protected by such fire department of
5 the Wallkill Hook, Ladder and Hose Co., Incorporated.
6 § 7. a. Precept for payment of foreign fire insurance premium taxes.
7 Such corporation shall collect and there shall be paid to it all taxes
8 imposed by section [five hundred fifty-three] nine thousand one hundred
9 four of the insurance law for the fire department use and benefit upon
10 premiums for insurance against loss or damage by fire covering property
11 situated in the Wallkill fire district located in the town of Shawan-
12 gunk, Ulster county, New York or within any duly organized territory in
13 which the Wallkill hook ladder and hose company incorporated is or may
14 be obligated to render fire protection.
15 b. The officers of said corporation designated by its by-laws to
16 collect and receive the aforesaid tax shall have all the same powers and
17 be subject to all the provisions of section nine thousand one hundred
18 four of the insurance law, relating to treasurers of fire departments.
19 c. Such corporation shall also be entitled to receive a share of the
20 tax imposed by section [five hundred fifty-four] nine thousand one
21 hundred five of the insurance law, based upon the business written in
22 the territory with respect to which it is entitled to collect and
23 receive the tax under section [five hundred fifty-three] nine thousand
24 one hundred four of the insurance law.
25 [Such taxes shall only be used for the care and relief of disabled or
26 indigent volunteer and exempt volunteer firemen and their families.] d.
27 Such taxes shall only be used by the corporation in furtherance of its
28 purposes as set forth in section three of this act.
29 § 2. This act shall take effect immediately.
