AN ACT to amend the public health law, in relation to determining eligi-
bility for the child health plus program, the medical assistance
program and the family health plus program
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 24 of section 206 of the public health law, as
2 added by section 39 of part C of chapter 58 of the laws of 2008, is
3 amended to read as follows:
4 24. Notwithstanding any inconsistent provision of law to the contrary,
5 the commissioner is authorized to receive applications and to determine
6 initial and continuing eligibility for enrollment under the child health
7 plus program established under title I-A of article twenty-five of this
8 chapter, the medical assistance program established under title eleven
9 of article five of the social services law, and the family health plus
10 program established under title eleven-D of such article. The commis-
11 sioner may exercise such authority with respect to all residents, or a
12 subset of residents, of one or more local social services districts.
13 [The commissioner is authorized to enter into one or more contracts,
14 which contracts shall be procured on a competitive basis pursuant to a
15 request for proposal process, for the purpose of exercising his or her
16 authority under this subdivision.] In exercising his or her authority
17 pursuant to this section, the commissioner shall utilize and employ only
18 public employees for the purposes of continuing and determining eligi-
19 bility for the child health plus program, the medical assistance program
20 and the family health plus program.
21 § 2. This act shall take effect immediately.
