        AN ACT to amend the town law, in relation to the date of public hearings
          by improvement district commissioners in the year 2013
 
          The People of the State of New York, represented in Senate and  Assem-

        bly, do enact as follows:
 
     1    Section 1. Subdivision 9-a of section 215 of the town law, as added by
     2  chapter 421 of the laws of 2008, is amended to read as follows:
     3    9-a.  Shall  annually prepare an estimate of proposed expenditures for
     4  and revenues of such district for  the  year  beginning  with  the  next
     5  succeeding  January  [fist] first.   Such estimate shall specify by item
     6  all proposed expenditures for general  purposes,  including  expert  and
     7  professional  services,  and for debt service. Such estimate may contain
     8  for contingent purposes, an amount not to exceed ten per centum  of  the
     9  amount  estimated  as  necessary  to meet the expense of maintaining the
    10  improvement exclusive of the amount necessary to pay  debt  service  and
    11  judgments.  The board of commissioners shall conduct a public hearing on

    12  such estimate on the first  Thursday  following  the  first  Tuesday  of
    13  September,  for  the  calendar  year two thousand thirteen on the second
    14  Thursday following the first Tuesday of September or, in Westchester and
    15  Monroe counties, the first Thursday following the first Tuesday of Octo-
    16  ber. Notice of such hearing shall be published  at  least  once  in  the
    17  official  newspaper  of the town wherein such district is located, or if
    18  no official newspaper has been designated by the town, in any  newspaper
    19  having  general circulation in the district. The notice may be published
    20  in such other newspapers as the board of commissioners may  direct.  The
    21  notice  of hearing shall be published not more than twenty nor less than
    22  five days prior to the day specified for  the  hearing.  The  notice  of
    23  hearing shall state the time when and the place where the public hearing

    24  will  be  held,  the purpose thereof, and that a copy of the estimate of
    25  proposed expenditures for and revenues of such  district  for  the  year

     1  beginning  with  the  succeeding  first  day of January is available for
     2  public inspection at specified times and at a  specified  public  place.
     3  After  the  public hearing, the board of commissioners of an improvement
     4  district may change, alter and revise such estimate prior to filing with
     5  the  budget  officer. Notice of such public hearing shall also be posted
     6  on the websites of the district and the town in which  the  district  is

     7  located,  provided such websites are maintained, on the signboard of the
     8  town and  conspicuously  posted  in  three  or  more  designated  public
     9  locations  within the district, on or about the day on which such notice
    10  is published.
    11    § 2. This act shall take effect immediately.
