AN ACT to amend the economic development law, in relation to adding the
Niagara Frontier transportation authority as an eligible applicant for
the western New York economic development fund
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivision 4 of section 189-a of the economic development
2 law, as added by section 2 of part GG of chapter 58 of the laws of 2012,
3 is amended to read as follows:
4 4. "Eligible applicant" means a private business, including a not-for-
5 profit corporation or the Niagara Frontier transportation authority
6 created under section twelve hundred ninety-nine-c of the public author-
7 ities law.
8 § 2. Section 189-c of the economic development law is amended by
9 adding two new subdivisions 4-a and 5-a to read as follows:
10 4-a. In reviewing an application submitted by the Niagara Frontier
11 transportation authority, the board shall establish criteria for the
12 expansion of bus route projects that would have the greatest economic
13 development impact. When considering the economic development impact,
14 the board shall consider the following criteria in relation to the bus
15 route project: job creation, and private and public investment. In
16 addition, the board shall determine that any expansion of bus route
17 projects funded under this chapter shall not impact existing bus routes
18 or bus route projects approved prior to any funding provided under this
19 chapter.
20 5-a. The board may recommend to the authority the allocation of fund
21 benefits for a transportation project related to the development of bus
22 routes with an economic development purpose administered through the
23 Niagara Frontier transportation authority. The board may include within

2 appropriate.
3 § 3. This act shall take effect immediately.
