AN ACT to amend the general municipal law and the executive law, in
relation to requiring police officers to be retrained in cardiopulmo-
nary resuscitation every two years
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Short title. This act shall be known and may be cited as
2 "Briana's Law".
3 § 2. The general municipal law is amended by adding a new section
4 208-h to read as follows:
5 § 208-h. Biennial police officer cardiopulmonary resuscitation
6 retraining. 1. Every police officer in a city, county, town or village
7 shall, every two years be:
8 a. retrained in cardiopulmonary resuscitation as defined by subdivi-
9 sion six of section six hundred twenty-one of the general business law;
10 and
11 b. required to demonstrate the satisfactory completion of training in
12 cardiopulmonary resuscitation.
13 2. The cost of such retraining shall be the responsibility of the
14 police officer, provided, however, that the city, county, town, or
15 village may, at local option, reimburse the police officer for all or a
16 portion of the cost of such retraining or may, at local option, provide
17 its own retraining program pursuant to paragraph a of subdivision one of
18 this section to such police officers.
19 § 3. The executive law is amended by adding a new section 232 to read
20 as follows:
21 § 232. Biennial state police officer cardiopulmonary resuscitation
22 retraining. 1. Every state police officer shall, every two years be:

1 a. retrained in cardiopulmonary resuscitation as defined by subdivi-
2 sion six of section six hundred twenty-one of the general business law;
3 and
4 b. required to demonstrate the satisfactory completion of training in
5 cardiopulmonary resuscitation.
6 2. The cost of such retraining shall be the responsibility of the
7 state police officer, provided, however, that the state may, at the
8 discretion of the superintendent, reimburse the state police officer for
9 all or a portion of the cost of such retraining or may, at the
10 discretion of the superintendent, provide its own retraining program
11 pursuant to paragraph a of subdivision one of this section to such
12 police officers.
13 § 4. This act shall take effect on the sixtieth day after it shall
14 have become a law.
