        AN ACT to amend the civil service law,  in  relation  to  directing  the
          granting  of  excused  leave  to public officers and employees of this
          state to undertake screening for cervical cancer
 

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The section heading and subdivision 1 of section 159-b of
     2  the civil service law, the section heading as amended by chapter 566  of
     3  the laws of 2006, subdivision 1 as amended by chapter 391 of the laws of
     4  2008, are amended to read as follows:
     5    Excused  leave to undertake [a] screening for breast cancer and cervi-
     6  cal cancer.
     7    1. Every public officer, employee of this state, employee of any coun-
     8  ty, employee of any community college, employee of any public authority,
     9  employee of any public benefit corporation, employee  of  any  board  of
    10  cooperative  educational  services  (BOCES),  employee of any vocational
    11  education and extension  board,  or  a  school  district  enumerated  in

    12  section  one  of  chapter five hundred sixty-six of the laws of nineteen
    13  hundred sixty-seven, employee  of  any  municipality,  employee  of  any
    14  school  district  or any employee of a participating employer in the New
    15  York state and local employees' retirement system or any employee  of  a
    16  participating employer in the New York state teachers' retirement system
    17  shall  be  entitled  to absent himself or herself and shall be deemed to
    18  have a paid leave of absence from his or her duties or service  as  such
    19  public  officer  or  employee  of  this  state,  employee of any county,
    20  employee of any community college, employee  of  any  public  authority,
    21  employee  of  any  public  benefit corporation, employee of any board of
    22  cooperative educational services (BOCES),  employee  of  any  vocational
    23  education  and  extension  board,  or  a  school  district enumerated in

    24  section one of chapter five hundred sixty-six of the  laws  of  nineteen
    25  hundred  sixty-seven,  employee  of  any  municipality,  employee of any
    26  school district, or any employee of a participating employer in the  New

     1  York  state  and local employees' retirement system or any employee of a
     2  participating employer in the New York state teachers' retirement system
     3  for a sufficient period of time, not to exceed four hours on  an  annual
     4  basis, to undertake a screening for breast cancer and a sufficient peri-

     5  od  of time, not to exceed four hours on an annual basis, to undertake a
     6  screening for cervical cancer.
     7    § 2. This act shall take effect on the ninetieth day  after  it  shall
     8  have become a law. Effective immediately, the addition, amendment and/or
     9  repeal  of  any  rule  or regulation necessary for the implementation of
    10  this act on its effective date are authorized and directed  to  be  made
    11  and completed on or before such effective date.
