        AN  ACT  to  amend  the  public  health  law,  in  relation to providing

          reimbursement to municipalities for certain services
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
 
     1    Section  1.  The  public health law is amended by adding a new section
     2  611 to read as follows:
     3    § 611. State aid;  optional  services.  State  aid  reimbursement  for
     4  public  health  services  provided  by  a municipality under this title,
     5  shall be made as follows:
     6    1. if the municipality is providing adult chronic  care  services  and
     7  such municipality is not the sole home health services provider, as such
     8  term  is  described  in  10 NYCRR 40-3.22(a), at a rate of not less than
     9  thirty-six per centum of the monies expended  by  the  municipality  for

    10  such  services.  No such reimbursement shall be provided for services if
    11  they are not approved in a plan or if no  plan  is  submitted  for  such
    12  services.
    13    2. if the municipality provides the following services:
    14    (a) early intervention services coordination;
    15    (b) dental services;
    16    (c) home health services;
    17    (d) long term care;
    18    (e) emergency medical services;
    19    (f) environmental services;
    20    (g) radioactive material licensing;
    21    (h) equipment licensing; or
    22    (i) housing hygiene;
    23    such municipality shall be eligible for reimbursement at a rate of not
    24  less  than  thirty-six  per centum of the monies expended by the munici-

    25  pality for such services. No such reimbursement shall  be  provided  for
    26  services  if  they are not approved in a plan or if no plan is submitted
    27  for such services.
    28    § 2. This act shall take effect immediately.
