AN ACT to amend the education law, in relation to requiring school
districts to provide information on head injuries to pupils and their
parents and requiring acknowledgment of receipt of such information
prior to engaging in interscholastic sports
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. The education law is amended by adding a new section 921 to
2 read as follows:
3 § 921. Information on head injuries for certain athletic partic-
4 ipation. Every school district, board of cooperative educational
5 services, and nonpublic elementary and secondary school shall distribute
6 to all pupil athletes an informational pamphlet to educate pupils
7 participating in interscholastic sports and persons in parental relation
8 to a pupil participating in interscholastic sports on the nature, inci-
9 dence, treatment, warning signs and risks of concussions and head inju-
10 ries and an acknowledgment of receipt of the pamphlet. A copy of such
11 pamphlet shall be provided annually to every pupil who participates in
12 an interscholastic sport prior to the first practice or tryout. The
13 acknowledgment of receipt shall attest to receipt of the pamphlet to be
14 distributed pursuant to this section and that the signators have read
15 and understand the nature and risks of concussions and head injuries. No
16 pupil shall practice for or engage in interscholastic sports until such
17 pupil and the person in parental relation to him or her have signed such
18 form. A new form shall be signed by the pupil and the person in parental
19 relation to him or her in every year in which such pupil practices for
20 or engages in interscholastic sports.
21 § 2. This act shall take effect on the first of July next succeeding
22 the date on which it shall have become a law; provided, however, that
23 effective immediately, any rules and regulations necessary to implement
24 the provisions of this act on its effective date are authorized and
25 directed to be completed on or before such date.
