AN ACT to amend the racing, pari-mutuel wagering and breeding law, in
relation to displaying live races and special events on telephones
The People of the State of New York, represented in Senate and Assem-bly, do enact as follows:
1 Section 1. Subdivisions 4-a and 5 of section 1012 of the racing, pari-
2 mutuel wagering and breeding law, subdivision 4-a as amended by chapter
3 18 of the laws of 2008 and subdivision 5 as amended by section 11 of
4 part L-1 of chapter 57 of the laws of 2009, are amended to read as
5 follows:
6 4-a. For the purposes of this section, "telephone betting accounts"
7 and "telephone wagering" shall mean and include all those wagers which
8 utilize any wired or wireless communications device, including but not
9 limited to wireline telephones, wireless telephones, and the internet,
10 to display live races and special events and transmit the placement of
11 wagers on races and special events offered by any regional off-track
12 betting corporation, and any harness, thoroughbred, quarter horse racing
13 association or corporation licensed or franchised to conduct pari-mutuel
14 racing in New York state.
15 5. The provisions of this section shall not be subject to the
16 provisions of section one thousand three of this article insofar as
17 those provisions require the participation as a contracting party or
18 otherwise of the regional off-track betting corporation, however no
19 races or special events shall be displayed without the express consent
20 of the originator of the races or special events, and this section shall
21 expire and be of no further force and effect after June thirtieth, two
22 thousand [ten] eleven.
23 § 2. This act shall take effect immediately, provided that the amend-
24 ments to section 1012 of the racing, pari-mutuel wagering and breeding
25 law made by section one of this act shall expire on the same date as
26 such section expires.
