        Introduced  by  M.  of  A.  ZEBROWSKI,  CUSICK,  ORTIZ  -- read once and
          referred to the Committee on  Health  --  committee  discharged,  bill
          amended,  ordered reprinted as amended and recommitted to said commit-
          tee
 
        AN ACT to amend the public health law, in relation to  adding  synthetic
          cannabinoids to the schedule of controlled substances
 

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
 
     1    Section 1. Schedule I of section 3306 of  the  public  health  law  is
     2  amended by adding a new subdivision (g) to read as follows:
     3    (g)  Synthetic  cannabinoids.   Unless specifically exempted or unless
     4  listed in another schedule, any material, compound, mixture, or prepara-
     5  tion which contains any quantity  of  the  following  substances,  their
     6  salts,  isomers  (whether optical, positional, or geometric), homologues
     7  (analogs), and salts of isomers and homologues (analogs), unless specif-
     8  ically exempted, within the specific chemical designation:
     9    (1) Naphthoylindoles. Any compound containing a 3-(1-Naphthyl)  indole

    10  structure  with  substitution at the nitrogen atom of the indole ring by
    11  an  alkyl,  haloalkyl,   alkenyl,   cycloalkylmethyl,   cycloalkylethyl,
    12  1-(N-methyl-2-piperidinyl)  methyl,  or  2-(4-morpholinyl)  ethyl group,
    13  whether or not further substituted in the indole ring to any extent  and
    14  whether  or  not  substituted in the naphthyl ring to any extent. (Other
    15  names in this structural class include but are not limited to:  JWH-015,
    16  JWH-018,  JWH-019, JWH-073, JWH-081, JWH-122, JWH-200, JWH-210, JWH-398,
    17  AM-2201, and WIN 552l2).
    18    (2)   Naphthylmethylindoles.   Any    compound    containing    a    1
    19  H-indol-3-yl-(1-naphthyl)  methane  structure  with  substitution at the
    20  nitrogen atom of the indole ring by analkyl, haloalkyl, alkenyl,  cyclo-

    21  allcylmethyl,  cycloalkylethyl,  I-(N-methyl-2-piperidinyl)  methyl,  or
    22  2-(4-morpholinyl) ethyl group, whether or not further substituted in the
    23  indole ring to any extent and whether or not substituted in the naphthyl
    24  ring to any extent. (Other names in this structural  class  include  but
    25  are not limited to: JWH-175 and JWH-184).
 
         EXPLANATION--Matter in italics (underscored) is new; matter in brackets
                              [ ] is old law to be omitted.

     1    (3)  Naphthoylpyrroles.  Any  compound  containing  a  3-(1-naphthoyl)
     2  pyrrole structure with substitution at the nitrogen atom of the  pyrrole

     3  ring by an alkyl, haloalkyl, alkenyl, cycloalkylmethyl, cycloalkylethyl,
     4  1-(N-methyl-2-piperidinyl)  methyl,  or  2-(4-morpholinyl)  ethyl group,
     5  whether or not further substituted in the pyrrole ring to any extent and
     6  whether  or  not  substituted in the naphthyl ring to any extent. (Other
     7  names in this structural class include but are not limited to: RVH-307).
     8    (4) Naphthylmethylindenes. Any  compound  containing  a  naphthylidene
     9  indene  structure with substitution at the 3-position of the indene ring
    10  by an  alkyl,  haloalkyl,  alkenyl,  cycloalkylmethyl,  cycloalkylethyl,
    11  1-(N-methyl-2-piperidinyl)  methyl,  or  2-(4-morpholinyl)  ethyl group,
    12  whether or not further substituted in the indene ring to any extent  and

    13  whether  or  not  substituted in the naphthyl ring to any extent. (Other
    14  names in this structural class include but are not limited to: JWH-176).
    15    (5) Phenylacetylindoles. Any compound containing  a  3-phenylacetylin-
    16  dole structure with substitution at the nitrogen atom of the indole ring
    17  by  an  alkyl,  haloalkyl,  alkenyl,  cycloalkylmethyl, cycloalkylethyl,
    18  1-(N-methyl-2-piperidinyl) methyl, or morpholinyl) ethyl group,  whether
    19  or  not further substituted in the indole ring to any extent and whether
    20  or not substituted in the phenyl ring to any  extent.  (Other  names  in
    21  this  structural  class  include  but are not limited to: RCS-8 (SR-18),
    22  JWH-250, JWH-203, JWH-251, and JWH-302).

    23    (6)     Cyclohexyiphenols.     Any     compound      containing      a
    24  2-(3-hydroxycyclohexyl)  phenol structure with substitution at the 5-po-
    25  sition of the phenolic ring by an alkyl, haloalkyl, alkenyl, cycloalkyl-
    26  methyl,   cycloalkylethyl,   1-(N-methyl-2-piperidinyl)    methyl,    or
    27  2-(4-morpholinyl)  ethyl group, whether or not substituted in the cyclo-
    28  hexyl ring to any extent. (Other names in this structural class  include
    29  but are not limited to: CP 47,497 (and homologues (analogs)), cannabicy-
    30  clohexanol, and CP 55,940).
    31    (7)  Benzoylindoles.  Any  compound  containing  a  3-(benzoyl) indole
    32  structure with substitution at the nitrogen atom of the indole  ring  by
    33  an   alkyl,   haloalkyl,   alkenyl,  cycloalkylmethyl,  cycloalkylethyl,

    34  l-(N-methyl-2-piperidinyl) methyl,  or  2-(4-morpholinyl)  ethyl  group,
    35  whether  or not further substituted in the indole ring to any extent and
    36  whether or not substituted in the phenyl  ring  to  any  extent.  (Other
    37  names in this structural class include but are not limited to: AIvI 694,
    38  Pravadoline (WIN 48,098), RCS 4, and AM-679).
    39    (8)              [2,3-Dihydro-5-methyl-3-(4-morpholinylniethyl)pyrrolo
    40  [1,2,3-del-i, 4-benzoxazin-6-yl]-l-napthalenylmethanone. (Other names in
    41  this structural class include but are not limited to: WIN 55,212-2).
    42    (9)            (6aR            1             OaR)-9-(hydroxymethyl)-6,
    43  6-dimethyl-3-(2-methyloctan-2-yl)-6a,7,         10,         1         Oa

    44  tetrahydrobenzo[cjchromen-1-ol 7370]. (Other names  in  this  structural
    45  class include but are not limited to: HU-210).
    46    (10)  Adamantoylindoles.  Any  compound  containing a 3-(1-adamantoyl)
    47  indole structure with substitution at the nitrogen atom  of  the  indole
    48  ring by an alkyl, haloalkyl, alkenyl, cycloalkylmethyl, cycloalkylethyl,
    49  1-(N-methyl-2-piperidinyl)  methyl,  or  2-(4-morpholinyl)  ethyl group,
    50  whether or not further substituted in the adamantyl ring system  to  any
    51  extent. (Other names in this structural class include but are not limit-
    52  ed to:  AM-1248).
    53    §  2.  This  act shall take effect on the ninetieth day after it shall
    54  have become a law.
