        Introduced  by M. of A. HYNDMAN -- read once and referred to the Commit-
          tee on Education
 
        AN ACT to amend the education law, in relation to enabling  students  to
          receive  information from colleges and universities without disclosing
          their personally identifiable information
 
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subparagraph 2 of paragraph f of subdivision 5 of section
     2  2-d of the education law, as added by section 1 of subpart L of part  AA
     3  of chapter 56 of the laws of 2014, is amended to read as follows:
     4    (2)  not  use  the education records for any other purposes than those
     5  explicitly authorized in its contract, provided,  however,  a  permitted
     6  use  which  may be authorized by contract may include voluntary programs
     7  through which students can  affirmatively  opt-in  to  be  connected  to
     8  nonprofit  colleges and scholarship providers and government agencies to
     9  receive information about their educational, financial aid, and scholar-
    10  ship programs and  conditional  offers  of  admission,  subject  to  the
    11  student's personally identifiable information not being disclosed by the
    12  third party contractor to such institutions;
    13    § 2. This act shall take effect immediately.
